The lawyers defending Ripple have recently written a <a href="https://storage.courtlistener.com/recap/gov.uscourts.nysd.551082/gov.uscourts.nysd.551082.297.0.pdf" target="_blank" rel="nofollow noopener">letter</a> to Magistrate Judge Sarah Netburn stating that the US SEC is requesting 1 million Slack messages and it is “burdensome and highly disproportionate.” Ripple said that reviewing over a million Slack messages would need a notable alternation of the present schedule.
<h2>Ripple Slams Request of SEC for Slack Messages</h2>
The lawyers representing the case of Ripple have argued that the motion by the Securities and Exchange Commission of the United States should be completely denied. 

In addition to this, Ripple’s lawyers pointed the fact that several other courts have not entertained these kinds of requests and have rejected <a href="https://www.cryptoknowmics.com/news/ripple-scores-against-sec-again-as-court-denies-request-for-documents/">similar</a> discovery demands. They said:
<blockquote>“Other courts that have considered similar discovery requests for Slack data have ruled that Slack discovery is uniquely burdensome and costly and have ruled against motions to compel their production in cases where the moving party has already obtained significant discovery.”</blockquote>
On the other side, the SEC has claimed that the Slack messages that are missing were related to the case and will definitely help them to refresh the memories of witnesses who are unable to recall important facts during the recent overturning.

However, Ripple has <a href="https://www.cryptoknowmics.com/news/brad-garlinghouse-of-ripple-slams-sec-and-shared-his-resentment-about-the-lack-of-clarity">clarified</a> that those messages are neither relevant nor distinctly important and mentioned the fact that the Slack messages have a low responsiveness rate provided that Ripple produced only 1,468 Slack documents out of the 115,000 documents it reviewed in the beginning.
<h2>Alternation of the Current Scheduling Order</h2>
The company warns the SEC that forcing it to collect the added Slack data will further alter the current scheduling order.

Also, it mentioned that the e-discovery vendor of the company estimates that it would take around 15 weeks to only retrieve the messages, and then again, Ripple will have to review them.

Initially, the e-discovery vendor failed to collect direct messages and multi-party instant messages due to a mistake that was discovered in the month of July.

The company, however, claimed that it then punctually began collecting the important data.
